Index error while using Mod pack

This seems to happen if the race (in this case Darlok) is going to surrender... I haven't reloaded yet and played to the same point.. I had just glassed their homeworld and demanded surrender from them and then got the index error (and hadn't saved for about 50 turns coz I was on the edge of my seat... grrrr).
