Because it is not on the planet. It is in the same sector. A sector is a huge amount of space, and the warp point and planet are nowhere near each other (in context of the sector). This is how you can have 10 WPs in the same sector, along with a Planet and Moons, and nothing bad happens from it (from the objects themselves, not from invading fleets  ). |
