The concept of abandonware is that if the owner cant be contacted, and the game cannot be purchased, then its abandoned.

It is in direct response to what you are asking about. NOt being able to contact the owner of a copyright presently does not release the copyright.
But even abandonware sites such as underdogs acknowledges that abandonware is an illegal concept
