Oh, I don't know - I could readily see something like that being staged - especially if the case revolves around that little itty bitty point in the EULA that AOL owns the IP ... after all, who's responsible for the damage a dog does, if not the owner? Who's responsible for the damage inflicted by a statement, if not the owner of the statement?
'Course, that assumes that the person suing is crafty-crazy, rather than standard-crazy...
