The Watcher is unavailable to both underwater nations because for some reason I forgot to give it amphibious abilities. That will be mended in version 1.1.

For the first one, you can't. Every nature wizard under the command of Man (the nation) can cast spell songs, and no mage of any other spell can cast any of them. With modding, you can give these spells to different nations as national spells, but there couldn't be "only if controlled by a Dirgesinger" variable. It is comparable to base Tien Chi Celestial Masters being unable to summon the national summons, despite thematic descriptions giving them the summoner's mantle.
Watcher would be a great pretender for any nation replacing Arcos, or if we will have a special dominions scrying as a theme for all nations in DomIII.
