To clarify - the moon resupply depot is the problem, for fighters only.

A battle does not need to occur for fighters to resupply at a full planet's resupply depot.

Fighters (and ships) also don't need to move away and back to the depot in order to get resupplied (as long as you don't mind waiting until the end of each turn(?).
