We've had this mentioned before. It's not a bug. It's the game deciding it has a better chance of damaging the target with the HE than with the AP.
You don't mention what the "hard targets" are or the range to target.
??
Save games are always helpful but I'm fairly certain this is the reason for using the "wrong" ammo.
