I have also noticed several times during SP games when a commander with a Ring of Water Breathing has died because he wouldn't retreat underwater even though he could have. It almost exclusively happens when the battle is on land, as retreating water to water is never a problem. No idea if this is a bug, WAD or ??? Maybe ask Edi to kindly take a look at the file and give his opinion on it (if you haven't done so already), and delay the game for a few more days until you get a judgement/answer.
I personally wouldn't be the biggest fan of re-running the turn, and would definitely vote against it. I engaged Pythium in many provinces last turn, had a lot of battles as a result, and won some that were less than 50/50. On top of this I had a few other 'nice' non-battle things happen as well, so Atlantis wouldn't be too happy at all if an excellent turn all round got taken away from them. But the majority decides I guess.

No, this is a simple case of moving into an adjacent water territory, from a water territory and failing to be able retreat back to the original territory. No other enemy troops, no other enemy actions.
I have already sent the original game file and made it available to edi and kristoff.
