First. there is a setting as to what a ship will or will not attack, and if this is set to not attack planets, then they won't. Check under Strategy and Tactics.
Second. If the enemy is constantly attacking you with Intel, then you are most likely using your available counter-intel to fend off maybe the first or even second intel attack, then all the others come through successfully. You might also want to check that you do not have the "divide points evenly" checked so that all your intel points go into your counter-intel. Lastly, make sure that your counter-intel project is the first project.
