Units on guard *DO* fire their weapons during an assassination: I had Illithids assigned to guard a Starspawn, and when an assassin attacked, the squids open fire.
I strongly suspect that guards drafted into an assassination fight using empty script, rather than Guard Commander, as they tend to rush the target, if melee, rather than hanging around the commander like they usually do.
