Almost sure it's a bug(or a very nasty random feature, hehe).

Seems like Ritual of Rebirth should really let you specify whom to revive.

As for characters not letting you remove their magic items, I see your point if you just revived them. Though on the other hand, try to get a magic item away from a player's RPG character some time...

I'm not trying to stack itens, I'm using two Vials of Water Breathing Pills in the same commander, those vial go on the Misc slot, and each commander has two of them. But it doesn't matter anymore as I got a Barrel of Idontknowhat that let me take 75 soldiers.

That's stacking. Two identical misc items on the same commander do not give you double effectiveness.
