Yea that was annoying. I had not actually paid attention enough in my gold games to notice it was different but have been basing my strategy assuming it was still there . So how does it work now?

The defender should go first, generally. Or it might be randomly determined, I forget which offhand...

The defender does go first in strategic or AI controlled tactical combat, however, in human controlled tactical combat you still get to go first regardless.

This was supposedly fixed in v1.68, according to the beta patch history thread {link}.
