A simple solution appears to be to NOT install to the default path. Choose an installation directory like "C:\Games\dominions3". I believe that the problem arises when the default path leads to the program files directory.

This is good advice regardless of whether you have Vista or XP. I have a separate Games folder on a separate partition from the operating system install partition. Helps keep things a bit more organized.
I have Vista and my saved games are in the dominions 3 folder but under the tab "Compatibility Files" near the top of the page. The CD key is also in this location.
Weird, I use vista (no matter cursed it be, I hate it, everyone hates it) and mine are in dominions3/savedgames/game_name folder like they should be. I've installed it into non-default path though.
Ballbarians user folder jungle sounds about what I'd expect vista to do.
