it is 1gb of dual channel ram, 2x 512mb sticks
all ram is fine, i do weekly checks
and I do not run direct anti virus software, I just have a automated daily scan by the server (it is complicated! i wont explain!)

That amount of memory should be fine; way more than fine to be honest. When I first got SE4, I was running it on a 256K machine and I don't remember getting any out of memory errors. Based on what you have said, I can't see why you are getting the errors.
If it isn't an excessively high numbers of units or ships, I don't know what would cause it. I think that would cause a range check error instead of an out of memory error, though.

256K? se4 must use very little memory.

Ouch. Yes, I was serious - and seriously wrong on my units . Should have been 256M instead of 256K. However that is 1/4 of the memory he's using so I really don't think it is a computer memory problem.
