Endless war

How can I sue for peace with another empire? I try offering a Non-intercourse, but is always rejected (with an empire at "brotherly" mood).

Also, why declaring war? Last game, I attacked a human colony not being at war, and they didn't even retaliate. In fact, they were "brotherly" in a few turns.

Can someone explain?
